MSME Development (Amendment) Bill, 2026
A 10 August 2026 status update to ARFMA’s original 30 July explainer: Parliament has now passed the Bill. The note explains the steps still required before its provisions operate and the separate CPSE TReDS rule already in force.
Document and present status
Follow-up to ARFMA's 30 July notice: the parliamentary status has changed since the original explainer was published. The substantive explanation below is retained, with the present status updated from “introduced” to “passed by Parliament.”
Bill No. LXXII of 2026 was introduced in Rajya Sabha on 28 July 2026. Rajya Sabha passed it on 3 August 2026 and Lok Sabha passed it on 7 August 2026. Parliament has therefore passed the Bill. As at 10 August 2026, ARFMA has not identified an official record of Presidential assent or commencement. The amendments should not be treated as operative until the required assent and commencement steps are officially completed.
Separate Gazette rule already in force: Ministry of MSME notification S.O. 3507(E), published on 30 June 2026, requires all operating Central Public Sector Enterprises (CPSEs) to route settlement of invoices for goods or services procured from MSMEs through an RBI-authorised TReDS platform. Routing is mandatory for the CPSE, but discounting or financing the invoice remains optional for the MSME supplier. This notification remains operative independently of the Bill's assent and commencement.

What Parliament passed
- MSME classification: classification would be based on both investment in plant, machinery or equipment and annual turnover. The Central Government would notify the thresholds instead of keeping them in the Act.
- Registration: filing would be voluntary for all MSMEs through a notified Central digital platform. States could also notify their own digital platforms.
- Payments through TReDS: Central public sector enterprises are already required by S.O. 3507(E) to route settlement of MSME invoices through TReDS. The Bill would place this framework in the Act and allow the Central Government to extend it to other public authorities, bodies or entities.
- Faster payment disputes: mediation would have a 90-day timeline from the first appearance. If mediation fails, referral to arbitration would be required within 30 days, with a 90-day timeline for an award after pleadings are complete.
- Money during a challenge: where a court challenge to an award remains pending for more than six months, at least 50% of the awarded amount deposited with the court would have to be released to the MSME supplier.
- Penalties and appeals: several criminal-fine provisions would become graded civil penalties, beginning with a warning in specified cases. The Development Commissioner would adjudicate, with an appeal to the MSME Secretary.
How this concerns and affects you
The practical effect depends on whether your mill is registered and classified as a micro, small or medium enterprise, and whether it is acting as a supplier or as a buyer.
- If your mill is a micro or small supplier: the proposed fixed timelines may make delayed-payment cases before the Facilitation Council more useful and predictable. Quicker release of part of an award during a prolonged court challenge could also improve cash flow.
- If your mill supplies an operating CPSE: invoice settlement must already be routed through an RBI-authorised TReDS platform. Your mill may choose whether or not to discount or finance that receivable on the platform.
- If your mill buys from micro or small suppliers: your existing duties on timely payment, interest on delayed dues and disclosure of unpaid MSME dues remain important. The Bill proposes escalating penalties for failure to report required unpaid dues in annual accounts.
- If your mill is close to a classification threshold: future notified investment and turnover limits could change its MSME category. This may affect eligibility for schemes and the protections available under the Act.
- If registration information is inaccurate: deliberate false information could attract a warning first and a monetary penalty for later contraventions. Accurate plant-investment and turnover records will remain essential.
What member mills should do now
- Check that the mill's Udyam registration, PAN, GST details, enterprise type and contact information are current.
- Keep invoice dates, written payment terms, delivery proof, buyer acceptance and payment follow-up records together.
- Separate receivables due from private buyers, government buyers and CPSEs. For CPSE receivables, confirm that invoice settlement is being routed through TReDS; decide separately whether financing or discounting is commercially suitable.
- As a buyer, maintain a reliable vendor process for identifying micro and small suppliers and tracking payment and statutory disclosure deadlines.
- Do not change contracts or compliance procedures solely on the basis of parliamentary passage. ARFMA will update this note when Presidential assent and commencement are officially recorded.

- सभी MSME के लिए पंजीकरण स्वैच्छिक होगा और अधिसूचित डिजिटल प्लेटफॉर्म के माध्यम से किया जाएगा।
- केंद्रीय सार्वजनिक क्षेत्र के उपक्रमों को MSME से खरीदी गई वस्तुओं और सेवाओं के चालानों का भुगतान TReDS के माध्यम से करना होगा।
- विलंबित भुगतान विवाद में मध्यस्थता के लिए 90 दिन, असफल मध्यस्थता के बाद पंचाट को भेजने के लिए 30 दिन और दलीलें पूरी होने के बाद पंचाट निर्णय के लिए 90 दिन की समय-सीमा प्रस्तावित है।
- यदि पंचाट निर्णय को चुनौती देने वाला मामला छह महीने से अधिक लंबित रहे, तो अदालत में जमा निर्णय राशि का कम से कम 50% MSME आपूर्तिकर्ता को देने का प्रस्ताव है।
